Welcome to Glintwall. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using Glintwall, you agree to be bound by these Terms. If you disagree with any part, you may not use our services.

1. Acceptance of Terms

By creating an account, purchasing wallpapers, or otherwise using the Glintwall website, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and agree to be legally bound by these Terms.

2. Description of Service

Glintwall provides digital wallpapers for desktop and mobile devices. Our services include:

Browsing and previewing digital wallpapers
Purchasing licenses to download wallpapers
Downloading purchased wallpapers in high resolution
Managing your account and purchase history

We reserve the right to modify, suspend, or discontinue any part of our service at any time, with or without notice.

3. User Accounts

3.1 Registration

To purchase wallpapers, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

3.2 Account Security

You agree to notify us immediately at contact@glintwall.com if you suspect unauthorized use of your account or any other security breach.

3.3 One Account Per User

Each user may maintain only one active account. Duplicate accounts may be terminated without notice.

4. Pricing & Payment

4.1 Prices

All prices are displayed in your selected currency and include applicable taxes where required. We reserve the right to change prices at any time, but changes will not affect orders already completed.

4.2 Payment Processing

All payments are processed securely through Stripe, Inc. By making a purchase, you authorize Stripe to charge your selected payment method. We do not store your credit card details.

4.3 Currency Conversion

For purchases in currencies other than USD, exchange rates are provided by a third-party service and may differ slightly from market rates. We are not responsible for discrepancies due to currency conversion.

5. Digital Goods & Refunds

5.1 Nature of Digital Goods

All wallpapers are sold as digital downloads. Once you download a wallpaper file, the transaction is complete and cannot be reversed.

5.2 Refund Policy

Due to the nature of digital goods, all sales are final. We do not offer refunds once a download has been initiated, except where required by law or in cases of technical issues that prevent delivery. Please see our Refund Policy for details.

6. License Grant

6.1 Personal Use License

Upon purchase, you receive a non-exclusive, non-transferable, perpetual license to use the wallpaper for personal, non-commercial purposes. This includes:

Using the wallpaper on your personal devices (desktop, mobile, tablet)
Making personal backups of the purchased files
Sharing personal screenshots or photos that include the wallpaper (e.g., on social media)

6.2 Prohibited Uses

You may NOT:

Redistribute, resell, or sublicense the wallpaper files
Use wallpapers for commercial purposes (businesses, advertising, merchandise) without a separate commercial license
Claim authorship or ownership of the wallpapers
Remove or alter any watermarks or metadata
Upload wallpapers to file-sharing services or public repositories
Use wallpapers in a way that violates any third-party rights

7. Intellectual Property

7.1 Ownership

All wallpapers, designs, and content on Glintwall are owned by or licensed to Glintwall. These works are protected by copyright laws and international treaties. Your purchase grants you a license to use the wallpapers, not ownership of the underlying intellectual property.

7.2 Trademarks

Glintwall, the Glintwall logo, and other Glintwall marks are trademarks of Glintwall. You may not use our trademarks without prior written consent.

7.3 User Content

If you submit content (e.g., reviews, feedback), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our services.

8. Prohibited Use

You agree NOT to:

Attempt to gain unauthorized access to our systems or other users' accounts
Use automated tools (bots, scrapers) to access our site without written permission
Interfere with or disrupt our services or servers
Circumvent any security measures or authentication
Engage in any activity that violates applicable laws or regulations

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The service will be uninterrupted, secure, or error-free
The wallpapers will meet your specific requirements
Any errors or defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLINTWALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE PRECEEDING TWELVE MONTHS, OR (B) £50 GBP.

This limitation does not affect your statutory rights as a consumer.

11. Indemnification

You agree to indemnify and hold harmless Glintwall from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of our services.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through:

Good-faith negotiation (preferred first step)
Mediation under the Centre for Effective Dispute Resolution (CEDR) procedures
Binding arbitration in London, UK, if mediation fails

12.3 Jurisdiction

For disputes that cannot be resolved through arbitration, you consent to the exclusive jurisdiction of the courts of England and Wales.

13. Termination

We reserve the right to terminate or suspend your account and access to our services, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your license to use purchased wallpapers remains valid for personal use, but you will lose access to account features and future downloads.

14. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Glintwall regarding your use of our services.
